visitation

My ex and I have a 3 year old daughter. He is convinced that she is not his… (SHE IS WITHOUT A DOUBT) I must mention our relationship lasted 5 years..he cheated constantly..I was dumb 21 and got pregnant. He has not seen her since she was 6 months old. I have never taken him to court because I feel that if he wants to be in her life he needs to make the effort and not be forced into her life.He insists on getting a paternity test outside of court. I refuse because he is sneaky and I do not trust him. I am wondering if some day he does decide to see her. will he be able to get visitation? Is this considered abandonment on his part??? Keep in mind that I called and e-mailed him dates to visit her for the first 6 months… then he took me to court for harrassment because he says I was intentionally causing him mental hurt… lol ofcourse it was thrown out of court…

Answer #1

He can visit her unless you get a court order for him not to. He is the father (no matter how bad of a father he is), and without a court order, he will be able to show up in her life and visit her is he decides to. If you dont want this to happen - you are going to have to take him to court and get full custody of your daughter.

Answer #2

He isnt even listed on the birth certificate…he refused to sign
