How is it that Sheriff can come into your back yard without a warrant?

Sad, Neighbor was arguing. Then sheriff broke in from the back fence, then Neighbors pit bull try to lunge at the sheriff deputy ( thats what he claims) he shot the dog in the mouth. Neighbor goes to jail, and the owner gets real piss………

Is that justified?

ummm a little unsure how they can just come in ur backyard and start roaming around unless he had reason to believe there was something back there that maybe he could see from the road. Its kind of like when u say its ok they can come in ur house without a warrant and they see something in eye’s view…its basically free game then.

the funny thing was that, the neighbors were arguing really loud, why didnt the officer just ring the door bell……you know how loud argurments can lead to at times……..there was also a sign that posted “beware of dogs”………. I think he put himself in danger by breaking into the fence rather then going through from the door……….

ur probably right….maybe he thought there was guns in that house and wanted to be sure he wasnt gonna startle them by knocking on the door….it sounds weird, but u never know the reason

The problem here is that we’re getting only one side of the story - I’m sure the sheriff has his reasons for what he did, and until we know what those are, nobody can create a justified opinion on right or wrong in this situation.

True…..i just wished he hadn’t come from the back, he place himself in more danger with the dog- Sign said beware of dogs- Its not the dogs fault that he was mining his own buisness, protecting his own back yard. by the way he is a very kind dog….

ok law enforcement answer. there are 5 types of searches. One of those is emergency. If I am in a neighborhood and I hear people fighting and I have probable cause that someone’s life could be in danger I can break down the front door if I have to without a search warrant. Again we don’t have the full unbiased story but from the look of it the fact that the sheriff came from the back means he was called about it or heard it while conducting a patrol we don’t typically go sneaking around peoples back yards for no reason. Him jumping the fence was to come from an unexpected angle and while they might have had beware of dog sign’s if they weren’t clearly visible from where the sheriff made his entry he was justified in shooting the dog because he was protecting himself and his partner. If a pit bull lunges at me I’m not going to see whether it is going to lick me or bite me I’m going to shoot it those dogs were bread to fight. as far as the neighbor going to jail there was a domestic disturbance it is standard practice of most law enforcement agencies to remove the aggressor until things are sorted out in a controlled environment. Again all the above is going off what was said.

funny thing was that there was a sign in front that the sheriff couldnt miss…beware of dogs……..the dog was actually shot pretty in front of the neighbors…….

Well if the sheriff had reason to be there and the dog attacked him then he has a right to protect himself. If a law enforcement official is called to you house and they are attacked they have the inherent right to self defense. Whether they are attacked by man or beast if they have a ligament reason for being there then they are justified in neutralizing the threat.

If I am called to a house for a domestic disturbance and I am presented with a situation where someone or something has the opportunity, capability, and intent to cause death or serious bodily harm to myself or someone else I will take appropriate action to ensure the safety of others and myself no matter who is watching.
