How do the IRS and income tax work?

hello! I have to know how IRS \ income tax work..okay this my problem I have a 7 yr old daughter and her father pay childsupport and he claims her on taxes but the thing is she live with me so I’m wonder if he was to claim then, I claim her also who will get the refund?

If you are the legal custodial parent then you are the only parent allowed to claim her on your tax return. Even if he already claimed her you should as well. Have documents ready when your claim is questioned to prove that you have the legal right to do so, He will have to return any money the IRS gave him for claiming her.

If you and her father lived apart during the last six months of 2009 and she received half of her support from you, you claim her as a dependent. Paying child support does not normally qualify someone to claim a child as a dependent.

If you both claim her as a dependent, you are 100% guaranteed to either have your return rejected or get audited. As soon as her SSN goes through the computer, it will be flagged.
