Can the state take custody of my son?

My girlfriend, who me and my son reside with occassionally, is on probation and has failed 2 drug tests. The state has filed a motion to take custody of her children and because I will not cooperate with them without a court order and we( my son and I) sometimes reside with her they want to include my son in this motion. Can they do this?

I am afraid they can, in the best interest of the child or any children being cared for by a drug-positive parent, do everything to cooperate, you may even have to find a seperate residence to protect him if she is losing her kids. Any child left in her care even part time would be at risk if they have taken hers. Dont take this lightly, get help, help her get help, you can get this whole situation turned around and have a positive outcome.
