Brother is going through a divorce, how to help?

…yeah ok so here goes.

My brother is getting divorced which in my opinion is cool with me.

But I have an issue…what if the mother keeps the child?

The mother’s character is severely flawed.

She is hot tempered and loses it so bad sometimes. She hits when she gets angry by the way. She respects no one but herself. She is a prissy woman.

She is all in all just rotten.

Can she lose the custody battle based on demeanor alone?

If so please tell me how I and my other family members who have seen this woman in action can pry lexi away from this situation.

Answer #1

Problem is, the US courts always side with the mother, even if it’s “wrong” …if you can catch her with her hand in the cookie jar in some fashion, breaking the law, etc, then your brother might have a better chance of getting custody.

At least, that’s the way it works in CA, as my uncle in law has been going though a similar deal for over a year…if your brother can spring for it, tell him to get a private investigator.

Answer #2

If he can prove that she’s not fit then the courts will not side with the mom. It’s about what’s best for the child(ren).

Answer #3

This is something that need to go to Family Court. You can express your concerns to the judge and go from there.
