If you place a cop under citizens arrest for unconstitional ...

..activity, and he resists, could he be charged with resisting arrest later?

For example, the unconstitutional seizures that have gone on in Tenaha Texas. What if the citizens detained had informed the officers they were under citizens arrest for violation of the US constitution? Could such an approach push back the tide of totalitarianism?

Answer #1

I’d like to think so, however in a case like this…it boils down to who has the gun. In a typical case, the cop has the gun, AND the regular person does not.

Personally, I’d like to see MORE police arrested for breaking the law…sadly, they aren’t, and usually they get “fined” or “non paid leave” from work, rather than facing the same penalty everybody else would get for the same offense.

Answer #2

The guy with the gun always wins the battle, but they might not win in court later on.

This is the best argument for maintaining the 2nd amendment as originally instituted. Attorney General Eric Holder and Chief of Staff Rahm Emanuel should be taking notes.
