question about a protective order,need help please

Ok so my best friend is really freaking out. Here’s the backstory. He had been dating this girl in a long distance relationship for nearly a year and a half when her parents got a protective order against him. He came home one day and it was laying on his porch. Well he was 17 and she was 15 when they got together and he had just been 18 a few months when he got it. The reason’s on it are all lies, because half of the stuff their is no proof of and its kinda ridiculous. The description of him on the papers is all wrong too,it says he has tattoos when he doesnt have a single one on him. Well anyway his girlfriend turns 18 in May and recently they got in contact with each other again. Well her parent’s found out and he’s worried that he’ll be sent to jail. I keep tellin him things will be ok,and he says he don’t get it because he’s no threat to her. She lives in Indiana and he lives in Virginia,over 400 miles away and he was waiting till she turned 18 to go see her.

So my questions are…

Is there a way to get around that? Can she get it lifted once she turns 18? And what are the consequences if they try to get him in trouble?

If the order is still in effect, there could be problems. When she turns 18, she should seek counsel and see what can be done.

Once she is 18 the question is mute. Up and till that time, if he is arrested for violating the order, she has the opportunity/ability to testify for him. She is the object of the order.

yes, but she was a minor at that time… her parents could get it then… now she’s an adult… unless she makes out a complaint, they cant make it for her (unless they can some how declare her incompetent, by like a psych eval or something…)

well see that’s the weird thing she wouldn’t talk to the cops when they got it against him because she said they had no reason to do it.

Yea the order was for 2 years which would make her almost 19 when it would be lifted. She wanted him to give her the case number on the order so she can go to the court herself and explain how everything they accused him of was a lie. The bad thing is…I’ve seen the papers…didn’t see a case number on it…also the judges signature is almost unreadable and their isnt any print on it showing his name and no phone numbers to contact him. Only thing I see is a seal from the clerk. Also it wasn’t given to him directly by an officer but was left laying on his doorstep in the rain.

Once she’s 18 they cant do anything… she has to be the one to make the complaint… without it, the cops cant do anything
