Can you be fired for an old misdemeanor?

Can a company fire you for a misdemeanor from 6 years ago? My husband was fired because 6 years ago he stole 12.00 worth of gas. He wrote it on his application and 2 months later after receiving his background check back, they fired him. Is that right?

well I know a female that was fired after her background check came back. before she applied for the job, she money and had to serve a few months. so, in a way I guess so. and I do think that is right, b/c the employer may think that since the person stole once, they may still again.

I would talk to your lawyer. If your husband had put it on his application and the company hired him they shouldn’t legally be able to fire him because he didn’t withhold the information pendding on the application. He was straighforward with the information. Your lawyer would know if the company was legally allowed to fire him under the circumstanses. Good Luck! FunMail me.

If it was in the application, and if that was the reason why they fired him, then no. However, if he did not put it in his application- YES! Also, they could fire him if there was a different reason. The only other exception is if his job requires him to pass a criminal background check (i.e securities and investing, working with children, working in a bank, etc…)

Also, if it has only been 6 years it’s not going to come off of the background anytime soon. I mean bad credit stays on for at least 7 years, and that’s not criminal.

Yes your husband can get fired for that even though it is absurd. I myself got into a fight with my brothers girlfriend 6 years ago and can not get a job for the life of me. I have been removed from jobs I had. I also have gotten hired and then the offer was reascended due to my simple misdemeanor charge. So unfortunately yes they use this against you because usually in an application they state that they can terminate you at anytime for any reason and that you can also resign at anytime for any reason. If you feel wronged in any way I would have a lawyer look over it but usually they do have the right.
