What do you think of John Tyner getting sued by TSA for refusing to be searched at the airport?

Im not sure what they story is…why is he being sued? Why not just deny him the right to get on the flight? If you refuse to be searched i feel they have the right to deny your flight, if my cancer patient father can go through a pat down with a colostomy bag, surly average people can suck it up and go through it as well.

That is what he did, he did not fly or want to fly, but now they are suing him because they say it is against the law to refuse a search.

As I understand it. Mr Tyner entered a security checkpoint. When he was informed his options were a body scan or be frisked he changed his mind and decided he wasn’t willing to do either in order to fly. Upon trying to leave the security area without being searched he was arrested.

In general refusing a search is not evidence of wrongdoing, were this the case than the 4th amendment would be powerless. The overriding purpose of check points is public safety rather than catching criminals. Since refusing a search makes being a public danger a possibility it could be argued that security had the right to apprehend Mr. Tyner. There may be other details in the case I’m not aware of but best I can tell TSA would have the right to apprehend Mr. Tyner to determine if he is a hazard but I don’t know where they would have grounds for an arrest.
