can a cop serch a car and open a Brief case with out a warrent?
IF they had probable cause Also if you got out of the vehicle it basically opens you up to a vehicle search you could have objected to the search but they usually talk their way in. once probable cause is established tho they own YOU AND the VEHICLE. they can search all day. if they smell or see booze or drugs that is enough to get in the car the breifcase is a logical place to look for something(checking for gun?)not knowing all the circumstances surrounding the stop its tough to say but I bet they did it right next time just dont consent to the search it'll piss em off tho nothin worse than a noncompliant motorist to a traffic cop be more careful...
yesh, because your in a public area. That's the same reason a cop can check people for guns with out a warrant. Houses and computers are private that's why they need a warrant. If the computer they were to check was at work they don't need a warrant. because its in a public area.
If the cop has "Probable Cause" yes they can search your car and possibly your brief case. Now what is considered "Probable Cause" is totally up to the cop, the sad truth is if they want to search you...they will find a reason.
