Overtime Pay
ok so from Aug 10th to aug 22 I worked a total of 58 point something hours. so when I got my pay check this time instead of overtime pay there is a whole new cadagory on my paystub for “Extra” pay at my regular rate.. thats total BS right I am not a salired employee actually I am a part time employee usualy getting just about 32 hrs a week .. this cannot be legal righ? If any one knows anything about this your imput would be much appericated byme and my coworkers who also got Extra pay instead of OT.
no my boss is no help she dont sign the pay checks she tries really hard but they are always messing with the payroll either its not on time or short. but I am luck to have a job in this economy. I just really want to know iffin we were getting screwed
your next source would be to contact corporate or hr. someone needs to at least give you an explanation on how you’re paid. You are entitled to know that.
It sounds like you may be getting screwed, however you need to confer with someone in HR is clearly familar with the laws as they relate to employee compensation. Your immediate manager may even be able to shed light on the matter. But it doesnt sound right.
Aug 10-22 is two weeks The federal law applies to overtime during a ONE WEEK period. Ist question is … did you work more than 40 hours during one 7-day work week? If the answer is NO, then sorry but you aren’t granted OT.
2nd question … are you in an exempt industry - agriculture and restaurants (including all fast food places)? If the answer is YES, again the federal law doesn’t grant you any OT.
3rd question … I’m sure there may be other limitations, but I don’t know what they might be. Ultimately this is a Dept. of Labor issue
A company can pay you OT over and above federal guidelines if they choose, but mandatory OT payment is covered by federal (and maybe state) law.
