He's not still alive, however, if he did come back he would be tried with fraud. It would also depend on what charges he had against him before his death, and all of the circumstances surrounding his death.

if he's in a witness protection thing like people say he is then he probably wouldn't get charged with anything.

but if he's not in a witness protection program then I'd say fraud.

The witness relocation program relocates people and gives them new identities, but it doesn't make their original identity die.
