Can I sue pontiac for my car accident?

I just recently got into a car accident in a Pontiac. My friend was driving and I was in the passenger seat, there was also someone in the back. The driver ran into a tree going at least 40-45 mph.I was wearing a seatbelt but the air bags didn't deploy on the car. So, I was thinking about suing Pontiac. The problem is that we were all drunk and I'm almost scared that since this is such a big company they might look into that and turn this around on me.

In general to successfully sue a company you need to show harm. How were you harmed by the airbag not deploying?

GM might actually offer to settle a friviolous lawsuit to avoid a trial and negative publicity so if you can find a lawyer who will sue you might get something but don't expect to get rich. BTW, the lawyer will get about half of the settlement.

I doubt it will be worth the trouble. Just count yourself lucky to not be seriously hurt and learn from your experience.

I mean...if it's not on record that you were drunk, then go for it...
but just think about it...this company is HUGE, and if you really think that
they are not going to ask questions, you are sadly mistaken...
*why were you out? *where were you going?
these are questions that they will ask, and they will look
at your background, because NOBODY wants to lose money...
so if your going to sue...look at EVERY possible aspect covered...
and just be careful driving from now on...they don't just put up
all those signs and commercials for AGAIANST DRUNK DRIVING
for NOTHING...I dunno...that
was a very irresponsible and immature thing to be doing...
And I'm glad that you are okay...But next time...don't drive drunk...
go to someones house that you can trust, and crash there...
don't be stupid...because you seem extremely bright...

I don't think it would be a good idea considering several factors (probably easily proven), not the least of which, you know it would be wrong....

I wouldn't these big companies will eat you alive because they are money grabbing people who wont give up without a fight and theres more of a chance in them winnig because they have money the main point is your still alive so just carry on living .

Ethically, you were drunk, and that was the cause of the accident.

From a purely financial viewpoint, they sold a defective vehicle.

Financially? It did not seem that you suffered any harm (you did not say), so its not worth it to sue them. Your friend is going to be in enough trouble already with the insurance company, rates going up and all of that. The fact that you can't prove that you were hurt is a strike against your potential claim.

Not worth the time and money.
