Can my girlfriend's mom make her move to canada?

Asked by joefares about 1 year ago, 2 answers.

Hi my current girlfriend is in a crisis, her mum has moved to Canada and she is currently living with her dad, her mum and dad split up ages ago. Anyway, my girlfriend wants to stay here in England but her mum is booking her plane tickets and everything without her dad's permission or my girlfriend's. Can my girlfriend's mum actually MAKE her move out to Canada? She really really doesn't want to even though I think it would be a great opportunity for her.

Thanks Joe

I'm not exactly sure concidering the fact I do not know your girlfriend's age. If she is over the age of 16 it is possible that she might be able to go to court and state her opinion. However, I also don't know what kind of relationship she has with her parents which could be a major factor. you might want to talk to a layer if this is a major issue.

That all depends on how old she is and which parent has custody of her. If her father is the one who has custody, than her mother can't force her to move. Even if he doesn't, she could probably take the whole mess to the courts and ask for a ruling. My parents are divorced as well, and I was told when I was very young that the courts would take my opinion into consideration at age 14. I don't know if things are the same where you live, but, good luck.
