18 year old dating 16 year old

Okay, I live in Texas... I've been dating this guy for over a year, we're engaged, but don't plan on getting married until he's 21. I was 16 he was 15 when we started dating. Now I'm 17 going on 18. and he 16. I heard when you're 17, the police can't make you go home, but could I get in trouble for satutary rape when he turns 17? We're getting a apartment, but his guardian is his 18 year old sister how really doesn't like me, I can see him, or talk to him on the phone for over 30 days, she keeps threatening to kick him out on the streets, but...she won't let him move in with me...

So my questions:

1. could I get in trouble for satutary rape?
2. can he move in with me without her consent?
3. should we wait till he's 18?( he's very head strong though, he's already ran away to my house before, but I took him back so she wouldn't send him to jail.)

if he's over 16 its not satutary rape, unless there's a big different in age.
if the sister doesn't want your boyfriend to live with you, then he can't because that would be consiterd a runaway.
I would suggest that if his sister really dosent like you then wait untill he's 18 because the sister could put a restrition mean she could go to the police and say she dosent want you to be near him. And if you don't listen you could be put in jail.
just stay away from the sister, and take it slow

You could go to jail (so maybe that's his motivation to stay home) for harboring a minor...

You might want to call the local police department (use a pay phone) just to be sure...

I liv in Texas and legaly it is stat. rape if you have ,u know...but they hardly ever charge a person that is dating a person so close in age. Also if he came and lived with you when he turned 17 his sister could press charges anytime if she wanted to,which would probbably be kidnapping even though you didnt kidnap him.
