Can a four-year-old child choose who he wants to live with when their parents get divorced or it is decided by the court?

Answer #1

That’s usually determined in court. This is because most 4-year-olds don’t have the proper experience or capacity to make an informed decision on the matter.

Answer #2

Does it mean that the court will not listen to the kid’s will?

Answer #3

That depends entirely on the precociousness and will of the child. If he/she is clueless, the judge will decide. If the child is aware of the situation and its +/- consequences then his/her thoughts will be taken into consideration.

Answer #4

At least that’s the way it should be. I can’t account for corrupt Judges…

Answer #5

Not in my country. The child has to be 11 years old in order for the courts to take his decision seriously.

Answer #6

In most countries, the judges will at least talk to the child and consider the childs wishes. Though if there is anything that the child is not aware of, such as one parent having an addiction or such as financial problems then the court will probably decide against the childs will.

Answer #7

Generally a child isn’t the one to decide until they r 12 yrs of age, before that the court decides

Answer #8

a child can’t decide till around the age of 13 I’m sure every state has different rules. courts prefer the parents work it out before court. but if not It’s a good idea to get a lawyer. but in most cases the mom gets the child unless there unfit.

Answer #9

i dont think that the child has the mental ability at this stage of his life. court might take a better decision.

Answer #10

I am way better off with my daughter than her father but she would pick him over me any day. Daddies girl. she is almost 4. But he has no job, lives with his mama and a hole bunch of other issues. I highly doubt that the court would go off what the 4 year old says. they only play favorites. becuz he isnt strict with her as i am

Answer #11

or in other law of the country, If the child is a minor or below 7 years old, automatically the Custody of this child is his Mother. In the event he is in the right age, then thats the time the court will let the child choose.

Answer #12

not in my land you have to be 14

Answer #13

I can understand that. And that is with happens with my friend. The kid wants to be with his mother but his father is way richer than the mother. The father has the money to pay for the court for having the kid with him. But the kid looks scared when he is staying close to his father.

Answer #14

it should be decided by the court because the child have no mental ability to decide it

Answer #15

well if the mother still makes enough to support the child they wont take the child from the mother. That is very rare unless she has problems. If she can still support the child but just isnt rich like the dad then mothers usually get favored.
