Sex with minor (19&17) legal questions

Asked by balzacketh over 3 years ago, 18 answers.

Hello,

Not the best place to post this I know, but I have been reading here a while and figure someone here might know something. Anyhow, let me go through my story here before someone thinks im a sick pervert. Im 19 years old, a...

semi-successfull entrepenuer, I make over $50,000 a year... I can support a child if necessary. I have been dating a girl for 7 months now, since she was about 16 and a half. Just recently we have engaged in sexual intercourse at HER sudgestion (3 times so far, she made it sound important to her). We use protection, no oral contraceptives but im not sure if I can get the pill in ohio without having her parents notified. Anyways, I heard from her sister of all things that she thinks she may be pregnant.

This is where it gets complicated. Her mom is beyond a prude. She is a christian phillantrapist that has forcebly homeschooled her daughter her entire highschool. Her mom then encourages a life of around 7 hours a night of TV... not in my opinion the perfect parent tm. Nevertheless, she has caused legal action against her other daughters boyfriend (for catching them kissing), but her other daughter was 14 at the time, and well... he was much older and not really the father type.

So I come here to ask a few questions. #1: if she turns out not to have a baby, how easy is it to get oral contraceptives without notifying the parents in the state of ohio. I am, of course, willing to pay premiums to keep my girlfriend safe. #2: though the age of consent is 16 in ohio (so I suppose I can not get statuitory), what other legal problems may I have as a consequence of my actions? #3: as a (potential) future father, what problems may her parents cause regarding me seeing her or the child (of course, the daughter and me have been steady but not sexual for 2 years, and are planning marriage as soon as she finishes college (shes in her sophmore college year as shes homeschooled))

Keep in mind that anything the parent (single divorced mom) would do is not in the same mind as her daughter. We are both aware of our actions and consequences (at least the portion involving conception)

Thanks In Advanced
A concerned future dad

i think its great that you are taking responcability for your actions... i would immediatly get a EPT, i know that in some states there are clinics, were you can get the pill for free... look around you may find something, the onlything i could forsee would be the mother taking gardianship of the child, therefore if she is pregnant, you need to show her mother that you can take care of her daughter, you make 50,000 a year, thats good, if you go to court over the gaurdianship, make a point to show that you can make the money to support her and the child~

I do know that in order to get any type of prescription birth control (be it the pill, the shot, the patch, iud... etc etc..) The woman has to be the one to get it. (I tried to have my bf pick mine up for me... they will not give it to ANYONE but who it is perscribed for.)

Now as far as consent, a woman can get contraceptives without parental consent(in most states) but must inform a parent or get a judicial bypass for an abortion.
more info: http://www.plannedparenthood.org/pp2/portal/

Alot of clinics base their services on income. (when I first moved and went to one I got pills free for 6 months! Now I pay only $7 bucks per pack and I have no health insurance.)

They also give free pregnancy tests and std screenings.

I do not think her parents can do anything if she is pregnant. You would be the father and would have rights as it would be your child. Unless they have a substantial reason which it sounds like they wouldn't. (And what kind of legal action can someone take for catching their daughter kissing!?!? WTF? lol )

If you guys didn't have a condom break or ejaculate near her vagina you should have nothing to worry about. I've been worried on alot of occassions that I was pregnant and I never was! Sometimes people perceive things when it is sort of worrisome. (Having to pee alot... getting sick in the morning... While they are signs of pregnancy... they are also signs of alot of other things! Drinking too many fluids.. having food poisoning.. etc.)

Thanks for your kind responses, I was expecting a lecture. I typed a long response out... twice, but it kept getting deleted.

Whether or not shes pregnant i plan on visiting planned parenthood with her fairly soon, have to find a way to break it to her though. If shes not pregnant, ill see if we can both take the consuling at get her pills (find some way to hide them from mommy), if she is pregnant, i feel ill probably need to do alot to make this a smooth pregnancy for both my kid and my girlfriend, Due to my girlfriends size (she is a cheerleader, tall and very very skinny, slightly out of shape now). Keep in mind she still has not had the guts to bring up the possiable pregnancy, and has only confided this to her sister who told me in secrecy why she was behaving oddly lately (her sister was acting in her interest). Does anyone have an idea on how I can bring this up without corrupting the trust of her sister?

As for the mom, heh. As I said its not simply a teenagers perspective. I was warned by adults in the community on dating my girlfriend, but I refuse to let one bad apple spoil a good relationship. Good does not always mean easy. As for what she did to the prior boyfriend of her sisters, that was a restraining order till she was 18 (4 years) and attributing to delinquancy of a minor for claiming the previous date (which she consented to) was her daughter running away. In jail a week with community service, and then on top of that he could no longer see her daughter. And that was just from a kiss (of course, not a peck, but still just a kiss)
She is a overprotective mom (thats why she put her kids in homeschooling), who thinks men are evil (she dated her highschool sweetheart, who cheated then divorced her , leaving her to take care of 2 kids alone). Shes now living with an alcoholic boyfriend for the past 14 years, who refusing to marry her , while she is paying 100% of the rent. I honestly think I could give a better life to both her daughter and my kid, as sad as that sounds.

Anyways, thanks again for all your help people!

This is the 4th post im attempting here....

I plan on taking her to the Planned Parent Hood center and attending consuling with her(either for the pills or pregnancy, depending on whether she is indeed pregnant). Of course, she still has not told me anything, so I need some way to get her to come out with it (I have been trying). her sister was the one who told me , she is my girlfriends only confidante, and i dont want to spoil her trust in her sister either. Any ideas here would greatly help!

Abortion would be a definite toughy right here. She may believe she is 2 weeks into it, but she doesent quite know what i know. The night she believes she would have concieved, I was wearing protection, and never really got into it, and never finished. Since the condom didnt break, I just think thats highly doubtfull, and at minimum I would have to point it to 3 weeks before that, or most likely 2 weeks before that (a condom broke on our first try, we were both virgins... im sure you know how that goes). that would put her at 5 to 7 weeks pregnant if she is, not 2. Of course, this isnt information that was awkward to tell as I didnt want her to feel like she performed badly or anything.... but if she is possibly pregnant she needs to know.

Ill make another post on her mom in a second, I dont want it deleated.

In kentucky you can get the pill without parents consent cause I was 15 when I responsibly put my self on the pill unfortunatly at 17 i ended up pregnat becuase my parents didnt think i NEEDED to be on the pilll. I suggest you go to the local health department and ask you dont have to give any information about yourself to get information.

Hi.
Firstly, no matter how much you love her, and she loves you,
and no matter how much of a great father you'd be (Because I can tell you would be a good one),
it is still STATUTORY RAPE.

–noun U.S. Law. sexual intercourse with a girl under the age of consent, which age varies in different states.

This means that if authorities knew, you would be arrested. Even if your girlfriend tells the police she wanted to, it still counts, and you're still arrested. And the jail time is severe.

I hope this will help.

Good luck.

well, the mom can't sue on the behalf of the daughter that is under 18 because she is 17 and you say the age of consent is 16.
You just have to wait until she is 18 and out of the nest.

well, the mom can't sue on the behalf of the daughter that is under 18 because she is 17 and you say the age of consent is 16. as long as she doesn't want to press rape charges herself your good.
You just have to wait until she is 18 and out of the nest.

@midnightfairy: next time read the question fully and you'd see she's not under age of consent

@everyone screaming rape: when this country started 14 year olds were marrying 40 year olds. not that I think it's right but don't criticize something you don't like just because your not familiar with it. Also if a states age of consent is 16 and the girl is 17 then it's not rape.

People, don't speak about law if you don't know what it is. The AGE OF CONSENT IN OHIO IS 16. This means that once any person in Ohio turns 16 years of age, they can have sex with whomever they want, without any legal repercussions on either side. He did not commit statutory rape. In the case of sex, in about 40 out of 50 of the states, at the age of 16 a person is considered an adult towards all things sexual. A few states are 18, and a few are 17 (with a few states being 14 for males and 17 for females).

For a list of age of consent by state, either google age of consent or go to http://www.avert.org/aofconsent

A lot of people are under that misinformation that no matter where you are in the state, if either person is under 18 someone is commiting a crime. This is not true at all. It depends on what state you're in, and the age of consent for that state.

In michigan, where I'm from, the age is also 16. the law clearly states that at the age of 16, a person is considered an adult in all sexual activities, and has the right to consent to sex. I'm 23 years old, if I so choose to have consensual sex with a person who is 16 years old, it is completely 100% legal and no one could do anything about it.

The big thing that shocked me here was that some people protested, and even called the OP a pervert or pedo...He's 19, and his girlfriend is 17...that's a 2 year difference. My mom had me when she was 31, my fater was 29, that's a 3 year difference, does that make my mother a pedophile because my dad is 3 years younger than her? In fact you'll find rarely are 2 people of the same exact age married, there is usually 2 - 5 years difference in most cases. I'm 2 years older than my fiance(she's 21). I was 21 when I met her, she was 19. Does that make me a pervert?

How about if you go to Germany(she's from Germany, and I was stationed there for 2 years). The age of consent for their entire country is 16, and it is very commonplace for a 16 year old to be with up to a 24 year old. The 24 year old there isn't at all viewed as a pervert. Only when it's a male of around age 30 trying to have sex with a 16 year old do people start questioning it.

The OP(original poster) is well within his legal rights, and has nothing to fear. I say good luck to you both, and may anyone who has a problem with the two of you be hit by a falling port-a-john :-)

My mum is a beyond a prude as well and when I was 17 I was dating a boy who was 20. Not in a pedophile type way, which is how she saw it. Me him had been close friends for years and finally decided to date. but even though the age of consent is 17 in IL, the fact that he was 3 years older than me made it illeagal she pressed charges now he's a registered sex offender for having sex with me after we had been dating for like a year. It was dumb.
