There is not reason of why your mom could not get him out of the house unless he actually owned part of the house or his name was on the lease. You should never back down to someone that is either raping/molesting/or sexual assaulting you no matter what the circumstances are. If you let him get away with it, it will kill you inside, later on in life and he will not just stop with you.

Tell some type of authority figure besides your mom since she obviously cannot solve the matter at hand.
