Unfortunately, we can' t give you legal advice here - we're not lawyers. And yep, I've dealt with the INS and now the DHS on immigration issues for my family as well. The best thing you can do is find a community, non profit agency in your area to give you a referral to a lawyer who can at least hear your case give you some suggestions and options.

If we give you advice, it could wildly inaccurate because we don't know the laws, facts, or circumstances.

Years ago, I worked at a non profit social services agency that helped Spanish speaking immigrants in the US...and, I'm willing to bet there are similar services where you live, if you call around and ask people in the local social services, government or similar offices, they can help direct you. Good luck.

So I assume you are not a US citizen either, or else you could have filed papers for him.

This is an extremely easy problem to solve. He can just walk into any Mexican consulate/embassy and get his passport renewed without any problems.

An interesting point:

Does U.S. require Passport of a person who is being deported?
If one does not have a passport, where will he be deported?

Answered by americana on Jun 08, 2009, 04:59PM

The US does NOT require a passport when they deport someone - my husband was deported without his passport and had to enter his native country with safe conduct - a note written by the US asking the other country to accept you back.

Also, if your husband entered without a visa he will probably have to return to Mexico for a period of time before returning to the US, but as someone else has said, I'm not a lawyer. It's probably best to speak to a lawyer.

My husband got his passport 2 years ago in Kansas City Missouri and they did not ask his immigration status they just asked for his birth certificate, proof of residence, and some other identification but NEVER did they ask anything about immigration status. You do not have to be a legal citizen to get a passport if you go to the Counsel of your birthplace. If he goes to a Mexican Counsel he will recieve a Mexican Passport. Hope this was a bit helpful. But just because he has a passport that does not mean he CANT be deported..that does not change his immigration status..he is still illegal.

it's all depend on the ambassy or consulat.but most of the time .they get deported because the country of origin just have to verify the passport number to see if it's match with the record.
I mean good luck
